Terms of Use

These Terms of Use (“Terms”) govern your use of the FOKUS mobile application and related website. FOKUS is operated by Gergely Chladny.
By using FOKUS, you agree to these Terms. If you do not agree, please do not use FOKUS.
1. About FOKUS
FOKUS is a German vocabulary learning application designed to support vocabulary acquisition through flashcards, smart repetition, vocabulary packs, progress tracking, and optional AI-assisted conversation practice.
FOKUS is an educational tool and does not guarantee any specific language-learning outcome, examination result, certification, employment result, or level of proficiency.
2. Eligibility
You must be at least 16 years old to use FOKUS. The optional AI Chat Buddy feature is currently intended only for users aged 18 or older, because the third-party AI infrastructure currently used by FOKUS is subject to an 18+ eligibility requirement.
3. No account required
FOKUS currently does not require a user account. Learning progress and related app information are primarily stored locally on your device. You are responsible for maintaining access to and security of your device.
4. Free content
FOKUS may provide free vocabulary content and features. The amount, structure, and availability of free content may change as the application develops.
5. Individual vocabulary packs
Certain vocabulary packs may be offered as one-time in-app purchases. Unless otherwise stated at the point of purchase, an individual vocabulary pack purchased as a one-time product is intended to remain available in accordance with the applicable Google Play purchase entitlement.
Purchases are processed through Google Play Billing. Restoration of purchases may depend on Google Play, your Google account, device configuration, and functionality available in FOKUS.
6. Premium subscription
FOKUS may offer an optional Premium subscription providing access to additional content or features. The price, billing period, included benefits, renewal terms, trial availability if any, and cancellation terms will be shown before purchase through the applicable Google Play interface.
Subscriptions may automatically renew unless cancelled through Google Play. Where required, FOKUS will provide an accessible method or link for users to manage eligible subscriptions.
7. Payments, cancellations, and refunds
Android purchases are processed by Google Play. FOKUS does not directly collect or store complete payment-card details.
Payment processing, cancellation, refunds, and billing disputes are subject to Google Play policies and applicable consumer law. Nothing in these Terms limits any mandatory consumer right that applies to you.
8. AI Chat Buddy
AI Chat Buddy is an optional feature intended to help users practise language through AI-generated conversation. AI-generated responses may be inaccurate, contain errors, misunderstand context, or produce inappropriate or unexpected output.
AI Chat Buddy is provided for language-learning and practice purposes only and should not be relied on for legal, financial, medical, safety-critical, or other professional advice.
Do not enter sensitive, confidential, or personally identifying information into AI Chat Buddy. When AI Chat Buddy is used, submitted messages may be transmitted to OpenRouter and relevant AI model providers for processing.
9. Vocabulary and educational content
We aim to provide useful and accurate vocabulary and translations. However, language depends on context, region, register, grammar, and usage. FOKUS does not warrant that every translation, example, AI response, vocabulary classification, CEFR indication, or learning recommendation will always be error-free or universally applicable.
References to CEFR levels or Goethe-related vocabulary are intended as learning guidance and do not represent certification, affiliation, approval, or endorsement by the Goethe-Institut unless explicitly stated otherwise.
10. Intellectual property
The FOKUS name, visual identity, original interface elements, original written content, application design, software, and other original materials are protected by applicable intellectual-property laws.
You may use FOKUS for personal, non-commercial learning purposes. You may not, without permission, copy or redistribute substantial portions of FOKUS content, resell FOKUS content, impersonate FOKUS, remove intellectual-property notices, or use FOKUS materials to create a misleadingly similar commercial service. Any rights granted by applicable law that cannot be restricted remain unaffected.
11. Acceptable use
You agree not to use FOKUS unlawfully, to interfere with or damage the application, attempt unauthorised access, transmit malicious software, abuse AI functionality, submit unlawful or harmful material through AI features, or infringe the rights of others.
12. Availability and changes
FOKUS is under active development. Features, vocabulary packs, AI functionality, pricing, interface elements, compatibility, and availability may change over time. We may modify, discontinue, replace, or improve features where reasonably necessary, subject to applicable consumer-law and platform obligations.
13. Third-party services
FOKUS relies on third-party services that may include Google Play, OpenRouter, AI model providers, Cloudflare, and email infrastructure. Those services operate under their own terms and policies. FOKUS cannot guarantee uninterrupted availability of a feature that depends on a third-party service outside our reasonable control.
14. Disclaimer
FOKUS is provided on an “as available” basis to the extent permitted by law. We do not guarantee uninterrupted operation, permanent availability of every feature, or error-free educational or AI-generated content. Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable consumer law.
15. Limitation of liability
To the maximum extent permitted by applicable law, FOKUS and its operator will not be liable for indirect or consequential losses arising solely from the use or inability to use the application. This limitation does not apply where liability cannot lawfully be excluded or limited.
16. Termination
You may stop using FOKUS at any time. We may restrict access to specific online functionality where reasonably necessary to prevent abuse, comply with law, protect third-party systems, or maintain service security.
17. Governing law and consumer rights
These Terms are governed by applicable law. If you are a consumer in the European Union or another jurisdiction providing mandatory consumer protections, nothing in these Terms deprives you of protections that cannot legally be waived.
18. Changes to these Terms
We may update these Terms as FOKUS develops or as legal, technical, or commercial requirements change. The current version will be published on this page with an updated revision date.
